Terms of use and privacy policy

Please read carefully before continuing to access Hillside Software's web sites

General

Hillside Software is the trading name of Hillside Software Publishing Ltd, a limited company registered in Scotland No. 131807.

The network of web sites operated by Hillside Software (the Web Sites) is comprised of various web sites and web pages.  Use of the Web Sites is offered to you on condition that you accept, without modification, the following terms and conditions.  Please read the terms and conditions carefully before continuing to use the Web Sites.

By accessing or using the Web Sites you agree to these terms and conditions, and all applicable laws.  If you do not agree to these terms and conditions you may not use the Web Sites.

Changes to These Terms of Use

Hillside Software may amend these Terms of Use from time to time.  If we make significant changes, we will post a prominent announcement on the home pages of www.hillsoft.co.uk, www.securitymanagement.co.uk, www.hillsidesoftware.co.uk and www.lowpaperdiet.com.

Use of Web Sites

Unless otherwise specified the Web Sites are for the purposes of providing you with information about the products and services offered by Hillside Software.  You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer or sell any information, software, products or services obtained from the Web Sites.

User Content

Unless you have been provided with an authorised 'Moodle' account by Hillside Software you may not upload or publish information on the Web Sites.  If you have been issued with an authorised 'Moodle' account you may upload and publish information subject to the following conditions.

Hillside Software allows Moodle account holders to make contributions to the Web Sites ("User Content") through instant messaging, bulletin board services, member profiles, and other means.

You agree not to submit or post any User Content that: (i) infringes the rights of a third party, including, without limitation, copyrights, trademarks, patents, trade secrets, rights of privacy and publicity, (ii) is libelous, defamatory or slanderous, (iii) condones, promotes, contains or links to warez, cracks, hacks or similar utilities or programs, (iv) is pornographic or sexually explicit, (v) does or may denigrate or offend any ethnic, racial, gender, religious or other protected group, through use of language, images, stereotypical depiction or otherwise, (vi) is designed to or does harass, threaten, defame or abuse others, (vii) exploits minors in a sexual or violent manner, (viii) promotes, condones or encourages illegal activity or (ix) is generally offensive or in bad taste.

You agree that all of your User Content, whether publicly posted or privately transmitted, is your sole responsibility. User Content does not necessarily reflect Hillside Software's views or opinions. We shall not be liable to you or any third party in any way for any User Content, including, but not limited to, for any errors or omissions in any User Content, or for any loss or damage of any kind incurred as a result of the use of any User Content posted, emailed, transmitted or otherwise made available via the Web Sites.

Hillside Software does not pre-screen, pre-edit or otherwise control User Content and, as such, does not guarantee the accuracy, integrity or quality of User Content.  By using the Web Sites, you agree to assume this risk. Hillside Software reserves the right, but has no obligation, to monitor interactions between you and other users of the Web Sites or take any other action in good faith to restrict access to or the availability of any material that we or another user may consider to be obscene, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable.

You agree to respect the rights of others and exercise good judgment.  Without limitation, you agree not to: (i) engage in unsolicited or unauthorized advertising or any other form of solicitation, including, without limitation, "pyramid schemes" or the distribution of promotional materials, "junk mail," "spam," or "chain letters," (ii) impersonate any person or entity or misrepresent your affiliation with a person or entity, (iii) forge headers or otherwise manipulate identifiers in order to disguise the origin of any User Content transmitted through the Web Sites, (iv) make available, introduce into or direct to the Web Sites any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, (v) interfere with or disrupt the Web Sites or servers or networks connected to the Web Sites, or disobey any requirements, procedures, policies or regulations of networks connected to the Site, (vi) violate any applicable local, state, national or international law, rules or regulations, including, without limitation, any rules of any national or other securities exchange, (vii) "stalk" or otherwise harass another person, (viii) "deep link" to any portion of the Web Sites, (ix) collect or store personal data about other users, (x) use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained thereon or for any other unauthorized purpose without our prior express written permission, (xi) take any action that imposes an unreasonable or disproportionately large load on Hillside Software's public webserver, (xii) display any of the Web Sites in a frame (or any of our content via in-line links), (xiii) engage in any activity that interferes with any third party's ability to use the Web Sites, or (xiv) assist any third party in engaging in any activity prohibited by these terms of use.

Intellectual Property

Except where identified below, the contents of the Web Sites, including but not limited to text, logos, and graphics are copyrighted and are the property of Hillside Software.

Moodle, which is used to power Hillside Software's Virtual Learning Environment, is an open source software package.

"3D Me" is a registered trademark of Hillside Software.

"Low-Paper Diet" is a trademark of Hillside Software.

The design of the www.hillsoft.co.uk Web Site is based on an original design by Andreas Viklund and is used with permission.

Copyright Infringement

Hillside Software respects the intellectual property of others, and we request users of the Web Pages to do the same.  Hillside Software will process and investigate notices of alleged copyright infringements and will act promptly to comply with applicable laws, by removing material from the Web Sites or disabling access to material.  Please email details of suspected copyright infringements to info@hillsidesoftware.co.uk

Typographical Errors

Hillside Software takes great care to ensure that the Web Sites are accurate.  However, it does not warrant that the Web Sites are free of spelling and typographical errors.

In the event that a product or service is listed at an incorrect price due to a typographical error, Hillside Software shall reserve the right to refuse or cancel any orders based on the incorrect price.

Third-party Links

Hillside Software is an affiliate of amazon.co.uk.  We may, from time to time, feature advertisements for this organization on the Web Sites.

The Web Sites may contain links to other, external web sites that are owned and operated by third parties.  Hillside Software has no control over these linked sites.  Links to the sites are provided for your convenience and you access them at your own risk.  Links do not imply that Hillside Software sponsors, endorses, or is affiliated with the organizations who own the external sites.  Please email concerns about links to external sites to info@hillsidesoftware.co.uk

Disclaimer

Hillside Software makes no warranties or representations about the accuracy or completeness of the Web Sites.  All content is provided "as is".  Hillside Software shall not be liable for any direct, indirect, or consequential damages arising out of the use of any content from the Web Sites.

Hillside Software does not warrant that access to the Web Sites will be uninterrupted or error-free.

Applicable Law

Your use of the Web Sites shall be governed in all respects by the Law of Scotland.

Privacy Policy

Hillside Software automatically receives and records information from our web server logs including your IP address and page(s) requested.  This information is not personally identifiable.

Hillside Software does not collect any personally identifiable information when you visit the Web Sites, unless you choose to submit a 'Request for Information' or you request a 'Moodle' account allowing you to use the Virtual Learning Environment.  If you submit a 'Request for Information', Hillside Software uses the information you provide to contact you regarding the topics that interest you.

Hillside Software will not sell, rent or transfer your personally identifiable information to anyone.

Hillside Software will not set or access cookies on your computer unless you are a subscribed user of the VLE.

Two cookies are used by the VLE.  The essential one is the session cookie, usually called MoodleSession.  You must allow this cookie into your browser to provide continuity and maintain your login from page to page.  When you log out or close the browser this cookie is destroyed (in your browser and on the server).  The other cookie is purely for convenience, usually called something like MOODLEID.  It just remembers your username within the browser.  This means when you return to the VLE the username field on the login page will be already filled out for you.  It is safe to refuse this cookie - you will just have to retype your username every time you log in.
